Construction

Since its founding in 1926, DK&S has built a long-standing reputation for expertise in construction law. Over the years, DK&S has offered owners, architects, engineers, contractors, sureties, product manufacturers and suppliers one of the largest and most experienced construction law staffs in the south. Our Construction Department includes several attorneys who are also trained in architecture or engineering. The depth of this experience is invaluable-whether negotiating a construction contract or litigating a construction dispute.

Our construction attorneys' expertise has led to many successful results in litigation and arbitration, including:
  • Architect and design professionals'errors and omissions
  • Bid disputes
  • Contract Disputes Act claims
  • Delay damage claims
  • Discrimination claims arising under Title III of the Americans with Disabilities Act
  • Miller Act claims
  • Mold claims
  • Personal injury and property damage resulting from the construction process or design error

Our construction attorneys work hard at keeping abreast with emerging trends in design and construction, and pass important information to clients through the firm's eNewsletter,The Legal Blueprint. Some of their outside activities have included co-chairing the ABA's Public Contracts Law Section, sitting on the ABA's Forum on Construction Industry's Governing Committee and sitting on the American Institute of Architects' Board of Directors. In the past, many of our department's attorneys also put their construction knowledge and experience to good use each October by participating in the annual community "Rebuilding Together" project. This is a voluntary activity where members of the community do construction related work on selected houses, whose owners are unable to do such work, either for health or financial reasons.

While we typically speak at several construction-related seminars throughout any given year and our lawyers have taught construction-related courses at local universities, perhaps our most ambitious and successful educational endeavor has been writing The Construction Industry Insurance Handbook, which John Wiley & Sons, Inc. published in 1991.

Our construction lawyers are knowledgeable counselors, and seasoned litigators who are dedicated to providing the most cost-effective solution for our client's problems. We share a strong commitment to the construction industry and look to expand the industry's use of alternative dispute resolution techniques to resolve construction disputes. Our commitment to the construction industry is strong and our efforts to continue building on our substantial foundation are sincere.
